JUSTICE VIKASH JAIN ORAL ORDER 03-03-2021 Heard learned counsel for the petitioner and learned APP for the State. Learned counsel for the petitioner has filed an undertaking to remove all defects pointed out by the Stamp Reporter as and when required. It is accordingly directed that all defects pointed out by the Stamp Reporter be removed within one month hereof.
2. The petitioner, who is in custody since 01.06.2019, has renewed his prayer for bail in connection with Bihra P.S. Case No. 79 of 2019 for the offences alleged under Sections 341, 342, 323, 307, 379, 504, 506/34 and subsequently added Section 302 of the Indian Penal Code, having earlier been rejected by this Court by order dated 11.12.2019 in Criminal Miscellaneous No. 63784 of 2019.
3. It is submitted that the petitioner has been falsely implicated in connection with assault by the accused persons upon the father of the informant who has been abducted and later on he was found by one Saraswati Devi in injured condition. It is submitted that the informant was not an eye-witness to the occurrence and as such, the detailed account of the assault as
Patna High Court CR. MISC. No.29980 of 2020(3) dt.03-03-2021 2/2 rendered cannot be believed. The said Saraswati Devi has not been examined. Other co-accused Bidyanand Roy and Nityanand Ray have been granted bail by this Court in Cr. Misc. No. 81366 of 2019 and Cr. Misc. No. 36825 of 2020, respectively. The petitioner claims clean antecedents.
4. Learned APP appears and has been heard.
5. Be that as it may, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bihra P.S. Case No. 79 of 2019, if he is not otherwise required in any other case.
6. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
