The petitioner is in custody in connection with Paharkatta P.S. Case No.104 of 2018 for the offences under Sections 323, 341, 504, 307 and 313 of the Indian Penal Code. Allegation against the petitioner is that he has assaulted the informant with kick blow.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 18.02.2019. Learned counsel further submits that after 08 months of the incident, Sections 307 and 313 of IPC were added to make the case serious.

Considering the fact that the petitioner has no criminal antecedent, the petitioner, named above, is directed to be

No.28853 of 2019(2) dt.01-05-2019 2/2 released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Tiwary, Judicial Magistrate, 1st Class, Kishanganj, in connection with Paharkatta P.S. Case No. 104 of 2018.
