The petitioner-school, represented through its Secretary, has approached this Court seeking a direction upon the respondents, especially respondent no.7, the District Education Officer, Banka to extend grant-in-aid for the year 2008-2009, which has not been given to the school (petitioner) till date.

3. Referring to Annexure-12, learned Advocate for the

Patna High Court CWJC No.8847 of 2025(2) dt.04-09-2025 2/3 petitioner submitted that the Director (Education), Bihar School Examination Board, Patna has issued letter as contained in Memo No.1120/24 dated 01.10.2024, making it clear that with respect to grant-in-aid of the school concerned, the District Education Officer shall be the competent authority to look into the matter and dispose of the same. Despite the request made by the petitioner, till date its claim for grant-in-aid for the year 2008-2009 has not been considered.

4. Learned Advocate for the State submitted that there is no such representation, showing the petitioner has ever represented before the concerned District Education Officer.

Having considered the submissions set forth by the learned Advocate for the respective parties and taking note of the grievance of the petitioner, the present writ petition stands disposed off with a liberty to the petitioner to approach before the respondent no.7, the District Education Officer, Banka, preferably within a period of four weeks' from today.

6. In case, the petitioner files an appropriate representation along with the necessary documents in support of its claim, the same shall be considered and disposed off by a reasoned and speaking order, preferably within a period of eight weeks' thereafter.

7. Suffice it to observe that in case, the claim of the petitioner finds favour, necessary consequential order(s) shall be passed.
