.... .... Opposite Party ====================================================== Appearance :

For the Petitioner/s : Mr. Pawan Kumar Singh For the Opposite Party/s : Mr. Manoj Kumar - 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2018 Heard learned counsel for the petitioner.

Petitioner apprehends his arrest in connection with Kishanganj P.S.Case No. 420 of 2013 registered for the offences punishable under Sections 419, 420, 406 and 120B of the Indian Penal Code.

Allegation against the petitioner, who was working in a non-Banking institution, is of cheating the informant by way of taking money and not returning the same and thereafter the company of the petitioner was closed.

Submission of learned counsel for the petitioner is that there is absolutely nothing against the petitioner as he has not taken money from the informant and moreover the informant has

Patna High Court Cr.Misc. No.47097 of 2018 (2) dt.14-08-2018 2/2 been made accused in this case.

Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides and in view of the fact that such type of bungling is being prevailed in the State of Bihar in the name of non-Banking Company which are running without any permission from the Reserve Bank of India, I am not inclined to grant privilege of anticipatory bail, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
