The petitioner apprehends his arrest in Marhowrah P.S. Case No. 482 of 2018, registered for the offences punishable under Sections 302, 34 and 120(b) of the Indian Penal Code.

Prosecution case is that due to land dispute all the named accused persons surrounded the informant's brother and started assaulting with lathi, Danda on his hands and legs. It is alleged that all the accused persons fled away after giving threat to the villagers not to help the injured (informant's brother). While the injured was taken to the hospital for treatment, he was declared dead.

It is submitted on behalf of the petitioner that there is

Patna High Court CR. MISC. No.33391 of 2019(3) dt.31-07-2019 2/2 case and counter case between the parties and petitioner has been falsely implicated in this case due to land dispute. There is general and omnibus allegation against this petitioner. One of the co-accused namely, Pramila Devi has already been granted bail by a Coordinate Bench of this court vide order dated 15.05.2019 passed in Cr. Misc. No. 31543 of 2019. Petitioner has got no criminal antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIII, Saran in connection with Marhowrah P.S. Case No. 482 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
