Patna High Court CWJC No.13693 of 2015 dt.11-08-2017 employee from Araria College, Araria. He has filed the present writ petition for a direction to the respondents for the payment of retiral dues such as, GIC, gratuity and leave encashment.
2. A counter affidavit has been filed on behalf of the respondent-University in which it has been stated that all the admitted dues of the petitioner has been calculated and he has been paid the amount of gratuity and leave encashment as well as group insurance.
3. On the other hand, learned counsel for the petitioner has submitted that no calculation chart has been provided to the petitioner and, thus, it cannot be ascertained as to whether the entire payment has been made or not.
4. Considering the submissions of the parties, the writ petition is disposed of with a liberty to the petitioner that in case he has any grievance regarding non-payment of any amount under any head of retiral dues, he may file a representation before the Registrar of the B.N. Mandal University within eight weeks from today. In case of filing of such a representation, the Registrar, B.N. Mandal University shall be required to examine the same and pass a reasoned order within a period of two months from the date of receipt of the representation. In case any amount is found admissible to the petitioner, the same shall also be paid to him within the aforesaid period of two months.
