The petitioner is apprehending his arrest in connection with Patepur P.S.Case No.80 of 2018 registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code. Allegation against the petitioner, who happens to be husband, is of dowry death.

Submission of the learned counsel for the petitioner is that the deceased has committed suicide and the petitioner has been falsely implicated in this case. Informant has also filed a compromise petition in the court of learned CJM, Vaishali at Hajipur.

Heard learned A.P.P. who has opposed the prayer for bail on the ground that there is allegation of demand as well as torture and the death is due to hanging, as such the petitioner

Patna High Court CR. MISC. No.29043 of 2019(3) dt.16-07-2019 2/2 does not deserve bail..

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below and make prayer for regular bail, which will be considered on the basis of submissions as made above as well as the materials on the record. With the aforesaid direction, this application is dismissed.
