Heard learned counsel for the petitioners and learned A.P.P. for the State, Shri. Chandra Bhushan Prasad. 2.

The petitioners apprehend their arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code and Sections 8 and 12 of POCSO Act. 3.

Learned counsel for the petitioners submits that petitioners being father, mother and brother of Amit, have been falsely implicated in the instant case by the informant. It is next submitted that Amit and the victim were in love and they eloped. It is next submitted that informant earlier also had instituted an FIR implicating the family members of Amit, when the victim had eloped

Patna High Court CR. MISC. No.34063 of 2024(5) dt.20-11-2024 2/2 with Amit earlier. It is next submitted that petitioners, Deepak and Mukesh had approached this court seeking regular bail by filing Cr. Misc No. 56337 of 2022 in connection with Buxar Town PS Case No. 237 of 2022 and the same was allowed by an order dated 22-32023 by a learned co-ordinate bench, in similar fashion again the petitioners have been implicated in the instant case. 4.

Learned A.P.P. for the State submits that today he talked with Sanjay Kumar Singh, S.H.O. of Buxar Town on mobile No. 6207926809, who informed that the victim has been recovered. 5.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Buxar Town P.S. Case No. 62 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) SUMIT/- U T
