The learned counsels are appearing and making submissions from their residence. The Court Master and Secretary are also part of this virtual court proceedings from their homes, all with the aid of audio visual technology.
Mr. Ajay Kumar Jha, APP is appearing for the State as it is submitted that the brief has been allotted to him by the office of Advocate General.
Heard learned Counsel for the petitioner and the learned Counsel for the State.
This Court would expect that the petitioner's Counsel would honour his undertaking in the instant proceedings regarding supply of requisite court fee etc. within two weeks from the date he is called upon to do so by the office.
Petitioner seeks bail in Lalganj PS Case No. 135 of 2019 registered under Sections 304(B) and 201/34 of the IPC. The prosecution case alleges that the informant's sister has
Patna High Court CR. MISC. No.30403 of 2020(2) dt.24-11-2020 2/2 been done to death on account of non fulfilment of demand for dowry. The petitioner is the husband.
It is submitted by learned Counsel for the petitioner that the victim died a natural death and that it is a case of false implication. The petitioner is in custody since 13.8.2019. Learned APP has opposed the prayer for bail. It is submitted that the body of the deceased has been cremated without intimation to the informant as per prosecution case. The petitioner being the husband owes prime responsibility towards safety and dignity of his wife.
Considering the rival submissions, for the present, this Court is not inclined to allow the prayer for bail. The same is rejected.
