The petitioner apprehends arrest in Nath Nagar P.S. Case No. 159 of 1997 instituted for the offence under Sections 364/34 of the IPC.

In the instant case, report has been called for from concerned court below which has been received. It is mentioned in the report that supplementary charge-sheet has been submitted against this petitioner and other accused persons on 28.02.2001 vide charge-sheet no. 51 of 2001, under Section 364A/34 of IPC showing this petitioner and other accused persons as absconder. Thereafter, on 18.05.2004 process under Sections 82 and 83 Cr.P.C. along with non-bailable warrant of

Patna High Court Cr.Misc. No.3242 of 2018(4) dt.03-04-2018 2/2 arrest has been issued against the accused persons with regard to whom chargesheet no. 51 of 2001 was filed showing them as absconder.

In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law, without being prejudiced by this order.
