JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Brahampur P.S. Case No. 291 of 2017, registered under Sections 147, 149, 341, 342 and 353 of the Indian Penal Code. The accusation is that on receiving information about blocking the Arrah-Buxar Main Road, the informant being the S.I. of Brahampur P.S. along with other police officials and Choukidar reached there and found that several vehicles including the Ambulance were standing on the road and 30-35 persons having armed with wood, bricks standing there. Thereafter, the informant

Patna High Court Cr.Misc. No.57753 of 2017 (2) dt.18-12-2017 and Choukidar tried to convince them then they become adamant and started to damage the vehicles, raising slogan against the police and creating disturbance. The petitioners were identified by the Choukidar and informant.

Learned counsel for the petitioners submits that it would appear from the F.I.R. that petitioners and others were only indulging in blocking the road due to murder of one person. While there is allegation against the mob to cause injury and damaging the vehicles but none had sustained injury.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Brahampur P.S. Case No. 291 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
