The petitioners apprehend their arrest in connection with Nagar P.S. Case No. 361 of 2017 registered under Section 302/34 of the Indian Penal Code.
Earlier prayer of the petitioners was rejected by this Court vide order dated 30.11.2017 passed in Cr. Misc. No. 49825 of 2017.
Learned counsel appearing on behalf of the petitioners submits that there is fresh material in the case. On perusal of Annexures -6 and 7 of the supplementary affidavit filed on behalf of the petitioners, it appears that a complaint petition
Patna High Court Cr.Misc. No.4661 of 2018 (2) dt.28-02-2018 2/2 was also filed by mother of the petitioners for the alleged occurrence and petitioners were admitted in the Hospital for treatment. He also brought on record the newspaper to corroborate their injuries, as detailed in Annexure-8 to the supplementary affidavit.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Gopalganj in connection with Nagar P.S. Case No. 361 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
