JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 This is an application for grant of anticipatory bail in connection with Durgawati P.S. Case No. 46 of 2019 disclosing offences under Section 304B of the Indian Penal Code. Prosecution story is that the petitioners happens to be the father-in-law and mother-in-law of the killed Rani Devi and administered poison with respect to the demand of dowry. There is also allegation of threatening and torturing also. Submission of the learned counsel for the petitioner is that no specific allegation had been attributed against any of the petitioner and it has also been submitted that petitioners are living separately and the husband of the deceased is already in jail. Heard learned A.P.P.
Having heard both sides, considering the above
Patna High Court CR. MISC. No.30709 of 2019(3) dt.19-07-2019 2/2 submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Durgawati P.S. Case no. 46 of 2019 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
