2. Petitioner seeks regular bail in connection with Beldaur P.S. Case No. 171 of 2022 in a case registered for the offences punishable under Sections 341, 323, 327, 448, 307, 379, 504, 506 / 34 of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was also added.

3. As per prosecution story, on 12.08.2022 at around 10:15 PM, all the FIR named accused persons including the petitioner and five to six unknown persons came to the house of the informant. It is further alleged that all the accused persons were armed with nut, iron-rod, lathi and danda and they abused and assaulted the informant and his family members due to which informant sustained serious injury on his hand, leg and whole body. Learned counsel for the petitioner submits that there is no specific allegation of any assault or overt act attributed against the petitioner, rather the allegation against him is general and omnibus. Similarly situated co-accused persons namely, Deepak Yadav, Ratilal Yadav and Jawahar Yadav have been granted regular by this Court vide orders dated 15.05.2023, 03.08.2023 and 06.12.2023 passed in Cr. Misc. No. 10324 of 2023, Cr. Misc. No. 30252 of 2023 and Cr. Misc. No. 64914 of 2023 respectively. Petitioner is in custody since 30.01.2025. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria, in connection with Beldaur P.S. Case No. 171 of 2022.
