2. The petitioner apprehends his arrest in a case registered for the offence under Sections 126(2)/115(2)/74/76/ 109/303(2)/324(4)/324(5)/3(5) of the B.N.S.
3. Prosecution story in short is that informant namely, Rimpa Kumari, alleged that all the named accused persons including this petitioner and one unknown accused came at the shop of her father and looted Rs. 65, 000/-. It is further alleged that this petitioner gave a weight blow (Batkhara) on the head of the father of informant causing grievous head injury who died during the course of treatment at Anugrah Narayan Magadh Medical College and Hospital, Gaya.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.29645 of 2025(3) dt.23-07-2025 2/2 petitioner has been implicated in this case due to dirty village politics. He further submits that general and omnibus allegation has been levelled against the petitioner. Petitioner has not assaulted the informant or his family members.
5. Learned A.P.P. for the State has opposed the bail petition and has submitted that four injuries were found on the person of the deceased. Petitioner has got one criminal antecedent.
6. Considering the aforesaid facts & circumstances and the fact that there is specific accusation of assault with weight blow (Batkhara) on the head of deceased is against this petitioner, this Court is not inclined to grant him bail. It is accordingly dismissed.
