2. The petitioner apprehends arrest in connection with R.P.F. Ara P.S. Case No. 814 of 2022 dated 19.06.2022 instituted under Sections 153, 174(a), 174(b), 174(c), 147 and 146 of the Railway Act.
3. The allegation against the petitioner is that he along with 200-250 persons damaged the railway property and attacked the police personnel during the protest against Agnipath Yojna of Indian Government.
4. Learned counsel for the petitioner submits that the petitioner is a student and he has been falsely implicated in this case. He was not involved in the offence and there is general
Patna High Court CR. MISC. No.34858 of 2023(2) dt.21-07-2023 2/2 and omnibus allegation against him. He has no criminal antecedent except one case which is also arising out from the said occurrence.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Bhojpur at Ara in connection with R.P.F. Ara P.S. Case No. 814 of 2022, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
