The petitioners apprehend their arrest in connection with Kahalgaon P.S. Case No. 51 of 2019, registered for the offences punishable under Sections 366(A), 34 of the Indian Penal Code.

One Amit Kumar Yadav is said to have kidnapped the minor daughter of the informant in the night to perform marriage with her and petitioners are said to have facilitated Amit Kumar in kidnapping.

It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. Petitioners

Patna High Court CR. MISC. No.30410 of 2019(2) dt.08-05-2019 2/2 have no concern with the aforesaid occurrence. They have been falsely implicated in this case merely because they happen to be the father and married sister of Amit Kumar Yadav. Victim in her statement recorded under Section 164 of the Cr.P.C. has stated that she has left the house for Kahalgaon without informing her family and met with Amit where-from they rushed to Bhagalpur and performed marriage. She has not disclosed the complicity of the petitioners in the occurrence. They have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P.S. Case No. 51 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) T.Kr./- U T
