2. The petitioner seeks bail in connection with Bachhwara P.S. Case No. 422 of 2024 dated 16.12.2024, instituted for the offence punishable under Sections 108, 3(5) of the B.N.S., 2023.

3. The allegation against the petitioner is that on the false promise of marriage, he established physical relation with the sister of informant. It is further alleged that he threatened the sister of informant to make her photo viral and defame her due to which, the sister of informant committed suicide.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this

It is further submitted that three years ago, there was talk of marriage between the petitioner and deceased but due to some reason their marriage could not be finalized. After this event, there was no contact between the petitioner and deceased. It is next submitted that there is no material available in the case diary to show that petitioner uploaded the photograph of deceased on social media or any other plateform to defame her. Police has recovered CDR of mobile of petitioner and others which reveals that there was no talk going on between petitioner and deceased between 14.11.2024 to 17.12.2024. Learned counsel further submitted that it is alleged in the FIR that petitioner was exploiting the deceased since 21⁄2 years but no complain was made by deceased against him. Lastly, it has been submitted that the petitioner is in custody since 03.03.2025 having no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount
