2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8/20(b)(ii) (c) of the NDPS Act.
3. The case of the prosecution is that from the possession of one Pramod Mahto, altogether 109.5 kg of ganja was recovered.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that the said Pramod Mahto has named this petitioner. Nothing has been recovered from the possession
Patna High Court CR. MISC. No.29891 of 2026(2) dt.08-05-2026 2/2 of the petitioner. He is having no criminal antecedent. It has further been submitted that similarly situated co-accused Naushad Alam @ Naushad Ali has already been granted bail by this Court vide Cr. Misc. No. 62943 of 2025. Moreover, the petitioner is languishing in judicial custody since 28.02.2026.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Adapur P.S. Case No. 04 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran at Motihari.
