2. The petitioner seeks bail in connection with Rosera P.S. Case No. 280 of 2022 dated 21.08.2022 registered for the offences punishable under Sections 379, 411 of the I.P.C.

3. As per prosecution case, the motorcycle of the informant bearing Registration No. BRO7AH 7220 was stolen by some unknown miscreants.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner is not named in the F.I.R and he has been remanded in this case from Alauli PS Case No. 392 of 2022. It is further submitted that the petitioner has been implicated in this case on the basis of confessional

The petitioner has no concern with the aforesaid incident and no recovery of any incriminating article has been made from the conscious possession of the petitioner. The petitioner is in custody since 20.09.2022 and has two criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Rosera, Samastipur in connection with Rosera P.S. Case No. 280 of 2022.

7. The application stands allowed.
