JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Giriak P.S. Case No. 99 of 2018, registered for offences punishable under Sections 419, 420, 467, 468, 471 of the Indian Penal Code and 66 of the I.T.Act.

As per F.I.R., allegation against the petitioner is that he along with others involved in running an on-line business on the basis of forged sim-card, forged bank account and forged address. Submission of the learned counsel for the petitioner is that the petitioner has been implicated in this case due to village politics rather the name of the petitioner has surfaced by the apprehended accused persons. It is also submitted that nothing incriminating has been recovered from the possession of the

Patna High Court Cr.Misc. No.45644 of 2018 (2) dt.06-08-2018 2/2 petitioner and the petitioner has no criminal antecedent. It is further submitted that similarly situated co-accused has been granted bail by this Court vide order dated 18.05.2018 passed in C. Misc. No. 28373 of 2018.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named on surrender or arrest within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st class, Nalanda at Biharsharif in connection with Giriyak (Katri Sarai ) P.S. 99 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
