JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2018 Earlier prayer for anticipatory bail of the petitioner was rejected by this Court vide order dated 19.4.2018 passed in Cr.Misc.No. 12817 of 2018.

Submission of learned counsel for the petitioner is that in the order sheet dated 19.4.2018 it has been written that petitioner was on leave but, as a matter of fact, petitioner on duty at that time.

Heard learned APP also.

It appears that prayer for anticipatory bail was rejected in the month of April, 2018 and now same prayer has been made. Petitioner ought to have surrendered and prayed for regular bail. Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory

Patna High Court Cr.Misc. No.47617 of 2018 (2) dt.08-08-2018 2/2 bail to the petitioner, rather petitioner to surrender within a period of six weeks from the receipt of this order and pray for regular bail, which shall be considered on the basis of materials available on record.
