Mr. Y.C. Verma submits that the respondents have modified the terms and conditions for participating in the tender during the pendency of the writ application. He submits that in view of the changed criteria the petitioner is qualified to participate in the tender process. Hence, direction may be issued to the respondents to issue fresh tender to allow the petitioner to participate in the tender process.

Patna High Court CWJC No.7859 of 2020(2) dt.22-09-2020 2/2 In view of the change in the terms and conditions and eligibility to participate in the tender, the writ petition is disposed of with liberty to the petitioner to approach the respondents to consider his case for participating in the tender for which he is qualified in terms of the amended terms and conditions for participating in the tender process.
