The petitioners seek bail in anticipation of their arrest in connection with Muffasil P.S. Case No. 77 of 2019, dated 12.02.2019, instituted for the offences

Patna High Court CR. MISC. No.25708 of 2020(2) dt.14-10-2020 2/3 under Sections 302, 201, 120(B)/34, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act. It has been submitted on behalf of the petitioners that petitioner No. 1 is not named and petitioner Nos. 2 and 3 are only said to have asked the whereabouts of the son of the informant, who, later, was found to be murdered. There is past enmity between the parties as well.

Learned counsel for the petitioners has submitted that because of the wife of the petitioner No. 1 earlier had run away with the deceased, such vindictive approach has been adopted by the informant. However, considering the nature of accusation against the petitioners, I am not inclined to grant anticipatory bail to them.

The prayer for grant of anticipatory bail is, accordingly, rejected.

However, should the petitioners surrender before the Court below and seek regular bail, the Court below shall consider the case on its own merits, without
