2. The petitioner seeks bail in connection with Balrampur P.S. Case No. 110 of 2020, registered for the offences punishable under Sections 419, 420 and 379 of the Indian Penal Code.

3. The FIR discloses a peculiar story which by no means appears to be believable. The officer-in-charge of the concerned police station had received telephonic information that one A.S.P. is coming to Gaya for arresting Pramod Kumar Kushwaha, a co-accused, who is suspected to be keeping one kilogram of gold. Another

For aiding in the investigation which was supposedly to be made by the A.S.P. who had come to Gaya, the Officer-in-Charge had deposited Rs.40,000/- in the Bank Account of Pramod Kumar Kushwaha, so that he could instill confidence in him and later nab him.

4. It was all a sham.

5. Pramod Kumar Kushwaha has been granted anticipatory bail. The other CSP organizer has also been granted anticipatory bail.

6. The petitioner however is in custody since 30.10.2023.

7. The accusation against him is that the telephone call came on his telephone, thus making him an accomplice in the whole drama.

Case No. 110 of 2020.
