JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2020 Heard Mr Prashant Sinha, learned counsel for the petitioner, State and Miss. Anukiriti Jaipuriyar, learned counsel appearing on behalf of respondent nos. 3 to 5. The petitioner has approached this Court with a grievance that there is some foul play by the respondents in the matter of entertaining the tender. He submits that in order to extend favour to the blue eyed, the tender was invited through E. tender process and the petitioner when tried to submit Etender, due to failure of the machinery of Beltron he could not be able to submit his E-tender.

Patna High Court CWJC No.7881 of 2020(3) dt.28-09-2020 2/2 In the aforesaid background of the submission, the Court granted order of status quo and asked for filing of the counter affidavit.

On behalf of the respondent corporation, a counter affidavit has been filed.

Learned counsel appearing on behalf of respondent no.3 informs the Court that as many as 37 tenderers have submitted their E-tender and having regard to the order of status-quo, tender has not been finalized as yet. Noticing the fact that 37 tenderers have participated in the tender through E-tender process, the Court is not inclined to grant any indulgence to this petitioner. However, liberty shall be available to the petitioner to approach the appropriate forum for redressal of his grievance as to failure on the part of Beltron/service provider in appropriate proceeding before the appropriate forum.

With the aforesaid, the writ application stands disposed of.
