2. The petitioner seeks regular bail in the present case registered for the offence under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. The petitioner is the brother-in-law of one Shahjad Ahmad. Three persons of the petitioner's family were killed by criminals 15-20 years back. Unknown criminals have killed the deceased.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 07.03.2024. Except for the confessional statement of co-accused(Shahjad), there is no

Patna High Court CR. MISC. No.34557 of 2024(3) dt.13-09-2024 2/2 material against the petitioner. Co-accused Shahjad Ahmad has been granted bail by a co-ordinate Bench of this Court vide order dated 09.05.2022 passed in Cr. Misc. No. 58457 of 2021.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan/concerned Court below in connection with Siwan Town P.S.
