Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioner is expected to honour his undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioner is apprehending his arrest in connection with Saharghat P.S. Case No. 26 of 2021 for the offence registered under Sections 447, 341, 353, 379 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that the informant lodged the first information report against the petitioner only with a view to harass the petitioner because he

Patna High Court CR. MISC. No.40744 of 2021(2) dt.22-10-2021 2/2 raised complaint against the P.D.S. Dealer and the said P.D.S. Dealer is under the jurisdiction of the informant. It is further contended that nephew of the petitioner has already been intimated the said facts to the Higher Official and due to this reason the present informant lodged a false case against the petitioner. It is further contended that the petitioner never misbehaved the present informant.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Benipatti, Madhubani in connection with Saharghat P.S. Case No. 26 of 2021 corresponding to G.R. No. 133 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
