====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 11-01-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Hisua P.S. Case No.166 of 2016 registered under Sections 304(B), 120(B) and 201/34 of the Indian Penal Code.

The accusation is of killing the deceased, the daughter of the informant, for non fulfillment of the dowry demand by her husband and other in-laws and also concealing her dead body to disappear the evidence.

Learned counsel appearing on behalf of the petitioners submits that the petitioner no.1, is married Nanand, petitioner no.2

Patna High Court Cr.Misc. No.1217 of 2018 (2) dt.11-01-2018 2/2 is mother-in-law and petitioner no.3 is brother-in-law of the deceased, the daughter of the informant, and used to reside separate to Pintu Choudhary, the husband of the deceased, the daughter of the informant but the petitioners have falsely been implicated in this case. Moreover, on trial, Pintu Choudhary, the husband of the deceased, the daughter of the informant, has been acquitted of the charges vide Judgment dated 28.04.2017 passed in Sessions Trial No.131 of 2017/19 of 2017 by the Additional Sessions Judge-V, Nawada.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Hisua P.S. Case No.166 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
