The petitioners seek anticipatory bail in connection with Nawada (Muffasil) P.S. Case No. 64 of 2018, registered for offences punishable under Sections 341, 323, 324 and 307/34 of the Indian Penal Code.
As per F.I.R., allegation against the petitioners along with others is of assault to the informant with Garasa and Khanti, Iron Rod, Lathi and other arms to the informant, causing injury. Submission of the learned counsel for the petitioners is that these petitioners are named in the FIR but there is general and omnibus allegation against them and the present case is
Patna High Court Cr.Misc. No.43909 of 2018 (2) dt.26-07-2018 2/2 counterblast of Nawada SC/ST P.S. Case No. 13 of 2018. It is further submitted that all injuries are simple in nature, caused by hard and blunt substance.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrender be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada (Muffasil) P.S. Case No. 64 of 2018 subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
