JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-02-2018 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Khagaria (Chitragupt Nagar) P.S. Case No. 665 of 2016 dated 23.11.2016 (G.R. 2463/16) for the offences punishable under Sections 341, 323, 307, 379/34 of the Indian Penal Code. In view of the fact that the accused persons i.e. the petitioners herein have been given the benefits of Section 41 of the Cr. P. C. and the trial court has also observed that the petitioners do not have any apprehension of arrest, it would be proper that the petitioners herein should surrender before the trial court within a period of two weeks from today and the trial court would consider

Patna High Court Cr.Misc. No.2354 of 2018 (3) dt.16-02-2018 2/2 the case of the petitioners for grant of regular bail and pass an order on the same day considering the fact that they are said to have not misused the protection granted under Section 41 of the Cr. P.C.
