In this case, learned counsel for the Union of India has raised an objection on the maintainability of the present writ application submitting that as the petitioner is a civil officer in Indian Army Force, he has a right to raise his grievance before the Central Administrative Tribunal.
In that view of the matter, learned counsel for the petitioner seeks permission to withdraw this writ application with a liberty to raise the grievance before the Tribunal. Permission is granted.
Accordingly, this writ application is dismissed as withdrawn with the aforesaid liberty.
