The petitioner seeks regular bail in connection with Motipur P.S.Case No.109 of 2019 registered for offences punishable under Sections 30(a), 38(1)(2), 41(1) of the Bihar Prohibition and Excise Act, 2016.

Prosecution story is of 36 ltrs. of liquor from a vehicle and thereafter on search recovery is from the house of the petitioner.

Submission of the learned counsel for the petitioner is that he has no criminal antecedent and the house is joint house and he is in custody for 2 1⁄2 months. He has no criminal antecedent and as the charge-sheet has been submitted, there is no chance of tampering with the evidence.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Motipur P.S.Case No.109 of 2019..

With the above direction, this application is allowed.
