JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 14-12-2022 Heard learned counsel for the petitioner, learned counsel for the Complainant and learned APP for the State. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 323, 498(A) and 504/34 of the Indian Penal Code.

Allegedly, it is a case of cruelty subjected to the complainant due to non-fulfilment of dowry demand. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner is the husband of the complainant and he is ready to keep his wife with full honour and dignity

Patna High Court CR. MISC. No.30949 of 2022(4) dt.14-12-2022 2/2 and the complainant is a government teacher as stated in para-12 of the petition.

However, learned counsel for the Complainant has opposed the prayer for anticipatory bail of the petitioner and submitted that the petitioner always misbehaves, abuses and tortures her due to which she does not want to live with the petitioner.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri K.P. Arya, Judicial Magistrate, Ist Class, Barh, Patna/concerned Court in connection with Complaint Case No. 355(C ) of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
