2. The petitioners seek bail in Chiraiya P.S. Case No. 588 of 2025 registered for the offences punishable under Sections 331(2) and 305 of BNS Act, 2023.

3. The allegation is that an FIR was lodged for theft of 948 bags of rice. The FIR was lodged against unknown.

4. Learned counsel for the petitioners submits that the petitioners are not named in the FIR and nothing was recovered from the possession of the petitioners. He further submits that the petitioners are in custody since 07.02.2026.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioners.

6. Considering that the petitioners are not named in the FIR and nothing was recovered from the conscious possession

Patna High Court CR. MISC. No.30120 of 2026(2) dt.06-05-2026 2/2 of the petitioners, this Court is inclined to grant bail to the petitioners.

Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1 st Class/concerned court Sikrahana at Dhaka, East Champaran in connection with Chiraiya P.S. Case No. 588 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure / Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
