JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-04-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Udwantnagar P.S. Case No. 154 of 2019 registered under Sections 147, 148, 149, 341 and 307 and, later on, added Section 302 of the Indian Penal Code, pending in the Court of the learned Additional Sessions Judge-XI, Bhojpur at Ara. Learned counsel appearing on behalf of petitioner submits that, earlier, the prayer for bail of the petitioner was refused on merit vide Criminal Miscellaneous No. 87262 of 2019 on 20.01.2020. Further submission is that while it is alleged that this petitioner had given Bhala blow at the head of deceased, but no any penetrate injury was found on the head of deceased, rather, the injury found on the head of deceased was

Taking into consideration that earlier the prayer for bail of the petitioner was rejected on merit vide Criminal Miscellaneous No. 87262 of 2019 on 20.01.2020, I am not inclined to reconsider the prayer for bail of the petitioner for the present. Accordingly, the prayer of the petitioner for grant of bail is again rejected.
