Petitioner seeks bail in Kazi Mohammadpur P.S. Case No.544 of 2018 instituted for the offence under Section(s) 302, 201, 120/34 Indian Penal Code.

Counsel for the petitioner submits that there is no allegation of any specific overt act against the petitioner. In the written report, it is alleged that one Ajay Patel phoned the informant to send Sunny Patel and Tinku Singh to his house to celebrate X-Mas party. It is further alleged that later on dead body of both persons were recovered from the railway line. The informant has raised suspicion against the petitioner in the written report.

Counsel for the petitioner submits that Ajay Patel has been granted bail by co-ordinate Bench of this Court. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1st, West-cum-Sub Judge, 1st, Muzaffarpur, in connection with Kazi Mohammadpur P.S. Case No.544 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
