Earlier the prayer for bail of the petitioner was rejected vide order dated 16.12.2019 passed in Cr. Appeal (SJ) No. 3693/2019 after noticing that the trial is going on and there are criminal antecedent of the appellant.

Learned counsel for the appellant has informed that all the prosecution witnesses have been examined in course of trial, learned counsel for the informant informed that the case is fixed today for recording of the statement of the accused under Section 313 Cr.P.C.

In the aforesaid view of the matter, learned Special P.P. for the State submits that since the trial is likely to come to

Patna High Court CR. APP (SJ) No.2021 of 2020(2) dt.21-12-2020 2/2 an end very soon, the appellant does not deserve privilege of bail particularly when his prayer has already been refused earlier.

Having regard to the facts and circumstances of the case, since the trial is going to be concluded in near future, in view of the reasons already assigned in the previous order, this court finds no further ground to enlarge the appellant on bail. Let the trial court conclude the trial within a period of three months from the date of receipt/production of a copy of this order.

This appeal stands disposed off accordingly.
