The petitioner apprehends his arrest in connection with Nokha P.S. Case No.151 of 2016 registered under Sections 304(B) and 201/34 of the Indian Penal Code.
The accusation is of killing the deceased, the niece (Bhagini) of the informant, for non fulfillment of the dowry demand by her husband and in-laws and relatives of her husband and to dispose of her dead body.
Learned counsel for the petitioner submits that, in fact, the petitioner is the brother-in-law (Bahnoi) of the husband of the deceased, the niece (Bhagini) of the informant, and used to reside
Patna High Court Cr.Misc. No.57114 of 2017 (2) dt.11-12-2017 2/2 at Aurangabad, which is 100 kilometers away from the place of the occurrence. The petitioner has falsely been implicated in this case being the brother-in-law (Bahnoi) of the husband of the deceased, the niece (Bhagini) of the informant. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sasaram, Rohtas, in connection with Nokha P.S. Case No.151 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
