JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 The petitioner is apprehending his arrest in connection with Navinagar P.S. Case No. 200 of 2017, registered for offences punishable under Sections 379 and 34 of the Indian Penal Code. Allegation against the petitioner and another is of taking away Rs. 49,000/- of the informant.

It has been submitted on behalf of the petitioner that he has no concern with the said allegation. Petitioner is the staff of the bus, in which petitioner was to travel when his bag was cut. Further no body has seen the occurrence.

Learned counsel for the State opposed the prayer for bail and submitted that the petitioner and one other was seen taking away the money of informant.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.4674 of 2018 (3) dt.28-02-2018 circumstances of the case, I am not inclined to release the petitioner on bail. This application is accordingly dismissed. However, if the petitioner so desire may surrender before the Court below and pray for regular bail, which will be considered by the court below on the merit of the case.
