Earlier vide order dated 15.3.2023 passed in Cr. Misc. No. 12062 of 2023, modification application of the petitioner was allowed and he was granted further four weeks to surrender in the court below but due to his ailment he could not surrender within time.

The petitioner has filed the instant application for modification of the order dated 15.11.2022, whereby while granting bail to the petitioner in connection with Didarganj P.S. Case No. 256 of 2020, the petitioner was directed to surrender in the Court below within a period of four weeks but he could

Patna High Court CR. MISC. No.33367 of 2023(2) dt.17-05-2023 2/2 not surrender within time because of his ailment. It is submitted by learned counsel for the petitioner that time for surrender be extended.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner and the contents of the modification application, the Court is inclined to allow the prayer of the petitioner. The order dated 15.11.2022 passed in Cr. Misc. No. 36242 of 2021 is modified and the time granted to the petitioner in the said order to surrender in the learned Court below is extended by a further period of four weeks from today. The bail bonds of the petitioner will be accepted by the learned Court below on showing receipt of deposit of Rs. 3,000/- before the concerned D.L.S.A..

The remaining part of the order shall remain unchanged.
