JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioners apprehend their arrest in connection with Danapur P.S.Case No. 533 of 2016 registered for the offences under Sections 341, 323, 353, 354B, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioners is that they have assaulted and abused the informant and also misbehaved with the police officer.

Submission of learned counsel for the petitioners is that as a matter of fact hot exchange of words took place between the parties and nothing has happened in this case and they have falsely been implicated and there is case and counter case between the parties.

In the facts and circumstances, let the petitioners, above named, in the event of their arrest within a period of six weeks, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Danapur, Patna, in connection with Danapur P.S. Case No. 533 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which their bail bonds shall be cancelled.
