The petitioner seeks bail in connection with Khagaria Rail P.S.Case No. 77 of 2018 registered under Section 379/411 of the Indian Penal Code.

Regard being had to the observations made by the learned Sessions Judge, Khagaria in his order dated 25.03.2019 passed in Bail Application No. 214 of 2019 that the stolen mobile was recovered from the possession of the petitioner and he tried to sell it to one Rupesh Kumar for Rs.3,500/-, but since no paper was given by him, the said Rupesh Kumar returned the mobile to the petitioner and the said statement of Rupesh Kumar has also been supported by two other witnesses, namely, Jayant Kumar and Kailash Singh, I am not inclined to grant bail to the

Patna High Court CR. MISC. No.33673 of 2019(2) dt.22-05-2019 2/2 petitioner for the present. The application is rejected. The learned Railway Magistrate, Khagaria is directed to expedite the trial, as charge-sheet has already been submitted, and conclude the same within four months from the date of receipt/production of a copy of the order, failing which the petitioner would be entitled to renew his prayer for bail.
