JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-08-2018 The petitioner is apprehending his arrest in connection with Ghanshyampur P.S. Case No. 73 of 2017, registered for offences punishable under Sections 341, 323, 324, 379, 376, 511, 504 and 34 of the Indian Penal Code.
Allegation against the petitioner is of attempt to commit rape on the informant.
It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and the F.I.R. itself shows that a talk of marriage between the petitioner and informant was going on and the informant was a consenting party. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case and the nature of accusation, I am not
Patna High Court Cr.Misc. No.50424 of 2018 (2) dt.31-08-2018 2/2 inclined to grant the privilege of anticipatory bail to the petitioner, rather he should surrender and pray for regular bail, which will be considered by the court below on the basis of materials available on record.
