The petitioner has renewed his prayer for bail in a case registered under section 307 and other sections of the Indian Penal Code and section 27 of the Arms Act. At the outset, it is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 12.4.2021(Annexure-1) passed in Cr. Misc. no.41141 of 2020 with liberty to renew his prayer for bail after completing one year in custody. He submitted that the petitioner has remained in custody for more than one year since 5.7.2020.

The application for bail is opposed by learned A.P.P. for the State and learned counsel for the informant who submits

Patna High Court CR. MISC. No.41102 of 2021(2) dt.30-07-2021 2/2 that petitioner is accused in as many as seven cases. He is creating havoc in the area and threatens the informant and others.

Having heard learned counsel for the parties and taking into consideration the liberty granted to the petitioner in the earlier order of rejection dated 12.4.2021 together with the petitioner having remained in custody for over 1 year since 5.7.2020, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.293 of 2020 (arising out of Dariyapur P.S. Case no.166 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Saran at Chapra.

It is directed that the petitioner shall co-operate in the trial and in case the learned trial court is of the opinion that the trial is being delayed due to non-cooperation on part of the petitioner, he may cancel the bail bond of the petitioner and take him into custody till conclusion of the trial.
