JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-04-2022 In pursuance to the direction of this Court, a supplementary affidavit has been filed on behalf of the petitioner explaining the reasons for not disclosing the criminal antecedent.

This Court, in clear term, had directed learned advocate-on-record Mr. Ajay Kumar Singh (A.O.R No. 1729) to file an affidavit as to why he had made a wrong submission before this Court regarding the criminal antecedent of the petitioner when he was advocate-onrecord in four other cases filed by the same petitioner before this Hon'ble Court which are numbered as Cr. Misc. No. 37278 of 2020, Cr. Misc. No. 39772 of 2020,

Patna High Court CR. MISC. No.40691 of 2021(5) dt.27-04-2022 2/3 Cr. Misc. No. 24124 of 2020 and Cr. Misc. No. 52603 of 2021 but today the supplementary affidavit has been filed on behalf of one Mahesh Kumar Singh, father-inlaw of the petitioner. The Registrar General, Patna High Court is directed to take necessary action against the erring persons.

Let a copy of this order be transmitted to the Chairman, Bihar State Bar Council for taking necessary action in this regard.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

There is recovery of 3025.88 litres of Indian made Foreign Liquor from a truck.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the Spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no

Since the petitioner in para 3 of the petition has submitted that he has no criminal antecedent but the same very petitioner has been allowed bail by this Hon'ble Court in four other cases which are numbered as Cr. Misc. No. 37278 of 2020, Cr. Misc. No. 39772 of 2020, Cr. Misc. No. 24124 of 2020 and Cr. Misc. No. 52603 of 2021 respectively, this Court is not inclined to grant anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail to the petitioner stands rejected.
