Initially Sakra P.S. Case No. 27 of 2015 was lodged on the fardbeyan of Rajeshwar Rajak wherein Rajeshwar disclosed that two groups of criminal fired at each other and one of the criminals died from whose possession loaded pistol and blank cartridge was recovered. The dead person was of Sanjeet Kumar Choudhary, son of Pramod Kumar Choudhary who is informant of subsequent Sakra P.S. Case No. 28 of 2015. In the subsequent FIR Pramod Kumar Choudhary has raised suspicion against the Mukhiya and others to have committee the murder. After investigation of both
Patna High Court Cr. WJC No.1029 of 2015 dt.13-10-2017 2 /2 the cases, the police submitted final form as clueless. The present writ application has been filed by the petitioner who is informant of Sakra P.S. Case No. 28 of 2015 for issuance of mandamus against the respondents for proper investigation of the case.
The counter affidavit would reveal that investigation is already complete now. If the petitioner is not satisfied with the result of the investigation, the petitioner would be at liberty to file protest in the case.
With the aforesaid observation, no persuasion is needed in this matter in view of the facts and circumstances stated above. Accordingly, this writ application stands dismissed. (Birendra Kumar, J) Kundan/- AFR/NAFR N.A.
