2. The petitioner seeks bail in a case registered for offence under Sections 3 / 4 of the Explosive Substance Act.
3. On 21.03.2020 at about 7:00 AM, the informant, who is S.H.O., received an information that one bomb was exploded and to verify the said information, he alongwith other police party left for the place of incident and saw that there were several villagers already present and the place of the blast was one bamboo cluster whereas the remaining parts of blast of the scattered around. The police officials then collected the materials from the spot and also conducted the search in the house of the co-accused Ishtekhar Ansari wherein he recovered several articles as mentioned in the seizure memo. The informant was informed that this illegal work has been done by the co-accused Istekhar Ansari as well as this petitioner, who are
Patna High Court CR. MISC. No.33182 of 2024(2) dt.12-07-2024 2/2 cousin brothers and they have concealed themselves since the time of the blast.
4. It is submitted on behalf of petitioner that petitioner is simply a victim of false implication. He has been made accused merely because he happens to be brother of co-accused Istekhar Ansari, who has already been granted bail by this Court, vide order dated 11.01.2021 passed in Cr.Misc. No. 30024 of 2020 (Annexure - 3). No incriminating article has been recovered from the possession of this petitioner. Petitioner is in custody since 19.01.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahana at Dhaka, East Champaran in connection with Ghorasahan P.S. Case No. 108 of 2020.
