JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 06-11-2017 The present writ petition has been filed for a direction to the District Magistrate, Muzaffarpur (respondent no. 2) to dispose of the appeal within one month which is pending since 26.02.2010.

2. It is submitted that an order of cancellation of the petitioner's PDS license was passed on 08.02.2010 by the S.D.O., East Muzaffarpur against which an appeal was filed before the Collector, Muzaffarpur.

3. None appears on behalf of the respondents. It transpires from para-15 of the counter affidavit on record that the petitioner's appeal has since been dismissed by order dated 02.09.2016 passed by the Collector, Muzaffarpur. A copy of the order passed in appeal has been annexed as Annexure-A to the counter

4. In the above view of the matter, the writ petition has clearly become infructuous. No rejoinder has been filed to controvert the stand in the counter affidavit. The writ petition accordingly stands dismissed.
