JUSTICE ARVIND SRIVASTAVA ORAL ORDER 03-05-2019 At the outset, learned counsel for the petitioner submits that petitioner no. 1 has been arrested during the pendency of this application, and as such, he seeks permission to withdraw this application on his behalf. In view of the above, the application stands dismissed as withdrawn as against petitioner no. 1. Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in connection with Sahiyara P.S. Case No. 19 of 2019 registered for the offence punishable under sections 188, 272, 273 of the Indian Penal Code and Section 30/30A of the Bihar

Patna High Court CR. MISC. No.28854 of 2019(2) dt.03-05-2019 2/2 Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to dirty village politics. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern with the alleged recovered materials. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner no. 2, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J. II-cum-special Judge, Excise Act, Sitamarhi in connection with Sahiyara P.S. Case No. 19 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
